We are delighted to be working in collaboration with the Law Society of Scotland's Update and the Scottish Young Lawyers Association to provide two seminars on "How to Instruct Counsel" under the Society's "CPD for New Lawyers series"

Ampersand's Simon Bowie amongst latest Advocate Depute appointments
The Lord Advocate, Elish Angiolini QC, today announced that the legal talent available for prosecuting cases in the High Court has reached an unprecedented level as six new Advocate Deputes were appointed to prosecute cases in the highest courts in the land, including Ampersand's Simon Bowie.

The Ampersand Planning and Environmental Law Group is hosting a planning seminar and workshops entitled "Renewable Energy and the Inquiry Process".
We are delighted that The Honourable Lord Mackay of Drumadoon has agreed to chair the event, as he has considerable experience to draw upon during the discussions that will take place over the course of the day. The speakers will include Ailsa Wilson QC, Maurice O'Carroll and Marcus McKay, all of whom have considerable experience in planning and environmental law and practice.

The House of Lords has recently issued its judgment in the Scottish case of Simmers v. Innes.
The case concerned the exercise of an option to purchase lands at a price to be determined by reference to a valuation to be produced by a valuer. The defenders declined to complete the transaction arguing that the valuation was not in accordance with the terms of the agreement between the parties and that on a true construction of the agreement the option was exercised by payment of the price by the pursuer on a single day only, that day having now passed. The pursuer sought implement of the option.

The annual joint Law Society of Scotland and Institute of Chartered Accountants in Scotland Discussion Group for Corporate Insolvency Specialists, which brings together the country's leading solicitors, accountants and bankers in the field of corporate insolvency takes place at the Dunkeld Hilton on Thursday 24 April.

Robert Weir returns to private practice
Following 3 years in the Crown Office as an Advocate Depute, Ampersand member Robert Weir will resume his full time practice at the Bar from today.

Barker v Lewis
Sheriff Principal R.A. Dunlop QC has now issued his judgment, in which he departs from the Sheriff's interpretation of the degree of "detriment" a benefited proprietor requires to demonstrate in order to enforce a real burden against a neighbour in terms of the Title Conditions (Scotland) Act 2003.

Rosaleen Kennedy v The Lord Advocate and Scottish Ministers Jean Black v The Lord Advocate and Scottish Ministers
Lord Mackay of Drumadoon has upheld two petitioner's contentions and found that both the Lord Advocate and the Scottish Ministers have acted in a manner incompatible with the Convention rights of the deceased in refusing any inquiry into the deaths of their relatives who died after they had become infected with the Hepatitis C virus while they were under the care of the National Health Service in Scotland.

Tawne Overseas Holdings Ltd v The Firm of Newmiln Farm & Others [2008] CSOH 12
Lord Malcolm has just issued his Opinion in this case, which involved an interesting consideration of the law of irritancy in relation to both commercial and agricultural leases. A novel issue in relation to the law on penalty clauses also arose.
