Summary
Before calling, Fiona Lake worked as solicitor specialising in commercial litigation and then as a legal translator for the European Court of Justice. Since calling, Fiona has been instructed in a wide range of litigation including both commercial and personal injury cases.
Experience
Fiona Lake appears regularly in the Court of Session and has significant experience in applications for interim interdict. She has also appeared in the High Court of Justiciary, Sheriff Court and before the Criminal Injuries Compensation Board.
Her commercial experience includes cases in relation to commercial contracts and commercial property. These contracts related to insurance, sale of businesses and shares, distribution, licensing and restrictive covenants.
Her intellectual property experience includes cases of trade mark infringement, passing off, infringement of copyright, database right and design right, unlawful use of internet domain names and software piracy.
In the professional negligence field, Fiona has acted in cases concerning solicitors, doctors, midwives and architects. Her experience of medical negligence cases includes birth injuries of cerebral palsy and quadriplegia, chronic pain arising from vasectomy, failures in diagnosis in gastrointestinal cases and failures to correctly administer anaesthesia.
Fiona Lake's personal injury practice includes employers' liability, occupiers' liability, road traffic accidents and industrial diseases. Fiona has appeared for both pursuer and defender, has experience in high value cases and has appeared in a civil jury trial.
